TERMS OF THE RESERVATION

This RESERVATION VOUCHER shall be governed by the stipulations attached being this nontransferable and issued exclusively for Guest and for the number of persons above described during days stated in this document.

For the effectiveness of this document, Guest will have to settle next amounts when due following the stipulations attached:

1. Balance of the stay of XXX Euros (XXXXXX Euros) payable 30 days before the arrival date.

2. Breakage Deposit of 150 Euros (One Hundred Fifty Euros) payable upon arrival and following the stipulations attached.

RENTAL CONTRACT FOR "HOLIDAY VISTA"

The stipulations listed below will be applied for any Guest staying at any accommodation of HOLIDAY VISTA.

1.- HOLIDAY VISTA, administered by M.K.M. INSULAR, S.L., with NIF: B-35667500 and address in La Caballa St, 7 local 2 in 35660 CORRALEJO - FUERTEVENTURA, henceforth HV, rents a house located in MIRADOR DE LOBOS GOLF, municipal term of Corralejo (La Oliva), being distributed inside with 3 bedrooms, living room, kitchen, 2 bathrooms (and a toilet only in “Duplex” accommodation), and outside with porch, parking space and private pool of approx. 5,50 x 2,20 mts. It is important to make clear that the responsibility of HV is limited solely to the enjoyment of housing, independent of common facilities or services offered by MIRADOR DE LOBOS GOLF, for example playing golf, clubhouse or the cafe bar and others, that are totally unrelated to our company which since we decline any responsibility for the conditions of use or any other aspect derived therefrom.

2.- The house is a hired accommodation on "room only" or "self-catering" basis and whose equipment and facilities, detailed in the various websites ads, are designed for temporary use for holiday purposes. Each house has tourist registration of the Government of the Canary Islands as "Vivienda Vacacional" whose references are:VV-35-2-0000285, VV-35-2-0000286, VV-35-2-0000287, VV-35-2-0000288, VV-35-2-0000289, VV-35-2-0000290, VV-35-2-0000291, VV-35-2-0000292, VV-35-2-0000293, VV-35-2-0000294 and VV-35-2-0000295.

3.- The exact allocation of the house for every Guest will be exclusively performed by HVaccording to its accommodations booking plan. The accommodation could be eithera “Duplex”, mainly distributed in two levels or “One-Storey”, mainly distributed in one level, both with same standard of equipment, main facilities and rental price.

4.-Under no concept or situation that takes place, the stay, subject of this contract, will not be valid beyond the contracted period, setting as standard check-in time from 15:00 and check out before 10:00. Late check-in after 22:00 will have an extra charge of 40 Euros.

5.- Special Requests requested by the Guest, such as: heated pool, different check-in or check-out timings of the accommodation, cots or extra beds, etc., are not guaranteed and will be dealt under terms of availability, accommodations booking plan and / or prior payment or express agreement with HV, and if so, finally specified in first page of this RESERVATION VOUCHER.

6.- THE TOTAL PRICE agreed by both parties will either have to be paid into HV bankaccount and as detailed below, or by credit card Visa or MasterCard alternately. HV won´t accept any bank charges caused by the issue of the transfer made in origin. That is to say, not shared or beneficiary fees are accepted. New taxes established after reservation date by the competent authority, shall be borne by the Guest.

A.The Guest will deposit in advance the amount of 30% of total agreed Price, as INITIAL payment. When this amount is paid, HV will issue and send to Guest´s e-email a RESERVATION VOUCHER which will include specific information of the agreed rental.

B.The BALANCE of total price agreed for the stay, will have to be paid 30 DAYS PRIOR the date of occupancy of the house.

C.The breach in the obligation to pay the rest of the stay and any other agreed payment within the period and appointed time, will result in the immediate cancellation of the stay and the nullity of Reservation Voucher issued:

7.- Additionally, the Guest will formalize on his arrival a BREAKAGE DEPOSIT of ONE HUNDRED AND FIFTY EUROS (150€) by credit card. BREAKAGE DEPOSIT will be returned 72 hours after the end of the lease if its application is not required once the house has been checked in the referred period.

8.- The house is rented for the temporary and exclusive enjoyment of the Stay Holder (or Guest) and the maximum number of persons stated in first page of this document. Guest is not allowed to invite others in addition for this purpose, or transfer unilaterally present RESERVATION VOUCHER to anybody else. Guestis not allowed also to have any kind of pets in the property.

9.- The house is rented in good conditions and fully operational as far as regards service facilities, being obliged the Guest to keep these conditions by a responsible use of them and assuming any damage of importance during the stay that could be detected in the property after having been examined at the end of the lease. The Guest will let free access to HV staff for any need of maintenance or management over the housing.

10.- Mentioned property is not rented by the purpose of satisfying the permanent need of the Guest for a house, as it is exclusively formalized for recreational temporary lodging purposes. Any commercial activity or business in this property is also not allowed.

11.-The Guest agrees to be responsible in following the required rules of coexistence and respect in the place, stopping themselves from loud parties and unhealthy activities, annoying or harmful, which may disturb the other adjacent users. The schedule of maximum rest to abide by the Guest is set between 23:00 to 10:00 of next day, which means that all noises or annoying actions that disturb the sleep of others must stop completely during this period.

12.- CANCELATION POLICY: Should the Guest cancel or reject use the property for any reason (voluntary or not), HV retain for itself the following penalties:

  • If cancellation / rejection occurs 60 days or more to expected arrival day, HV will retain 20% of the amount already paid by the Guest to date.
  • If cancellation / rejection occurs between 59 and 40 days to expected arrival day, HV will retain 40% of the amount already paid by the Guest to date.
  • If cancellation / rejection occurs less than 39 days to expected arrival day, HV will retain 60% of the amount already paid by the Guest to date.

HV recommend to the Guest hiring one of the many existing travel insurances to cover any undesirable issue that can make him cancel or reject his stay (illness, delays, flight cancellations, theft, epidemic outbreaks, force majeure, unforeseen events, etc...). Or that Guest check whether his credit card has integrated travel insurance, in which case the whole stay can be ensured by paying with it.

Subsequent changes of any kind to the agreed RESERVATION VOUCHER requested by the Guest, are subject to availability and administrative expenses, the amount of which will depend on each case but always previously notified by HV.

13.- The Guest is aware that this agreement will be dissolved immediately if he breaks any of the obligations herein and will also be invited to leave the property in the same act. In this case HV will retain all the amounts paid for the stay due breach contract of the Guest. If the Guest does not vacate the house, either for having fulfilled the agreed period or for breaching of the contract, shall make the Guest liable to pay a penalisation of a sum equivalent to triple the daily rent, until free availability of the home to HV, notwithstanding the costs, expenses and other compensation that may be due, including the fees of lawyers and procurator, although their intervention may not be required. For the hypothetical cases of force majeure such as earthquakes, severe flooding, loss of some of the supplies essential services (electricity and water), or any unforeseen and scenario outside HV responsibility making it impossible the use of housing for the purposes described, will result in a refund to the Guest of amounts received to date for the stay.

Purpose of the treatment: We treat the information you provide us for the integral management of the contracted service, the leases of the entity. Data conservation criteria: they will be kept for no longer than necessary, to maintain the end of the treatment and when it is no longer necessary for that purpose, they will be eliminated with adequate security measures to guarantee the pseudonymisation of the data or the total destruction thereof. Legitimation: RGPD: 6.1.b) Necessary treatment for the execution of a contract in which the interested party is part of or for the application at its request of pre-contractual measures. Recipients: The data will not be communicated to third parties, except legal obligation. Rights of interested persons: You have the right to obtain confirmation, on whether "M.K.M. INSULAR, S.L. ", we are treating your personal data therefore you have the right to access your personal data, correct inaccurate data or request its deletion when the data is no longer necessary, portability of the same, opposition and limitation to your treatment. You also have the right to withdraw your consent at any time and to file a claim with the Control Authority (https://www.aepd.es/reglamento/derechos/index.html), if you consider that the treatment does not conform to the regulations in force.www.agpd.es. 15.- Both parties expressly waive their own jurisdiction, if any, to be subjected for as many differences may arise in the interpretation and enforcement of this agreement to the Courts or Tribunals of Puerto del Rosario.
